Hi Davide!
I’m Antoine, a college student from Sun Yat-sen University in China, and I’m working on my graduation short film called SOLEIL. I am writing to you because I want to use some of Dusty Kid’s music and ask about the licensing copyright.
The film explores the soul and body, and some of the confusing struggles of the individual. I am one hundred percent sure that techno and electronic music are exactly what this film needs. As the saying goes: “You can hear the sound of the soul in electronic music.” In my own experience, Dusty Kid’s music has given me a lot of comfort. That’s why I immediately thought of his work when preparing the music for this film.
As this is a graduation film, it is entirely self-funded. It cost me 40,000 RMB to finish shooting, which is a big number for me as a student. It will only be shown at our university’s Graduation Screening, which is non-commercial. After that, I plan to submit it to some film festivals, like the FIRST International Film Festival in China. Because of this, I want to ask you about the copyright of these amazing songs.
The tracks I hope to use are:
- Innu (6s)
- Prelude (full)
- The Arsonist Part III (7min)
- Masua (2min 05s)
- Chelu ‘E Ruas (1min)
- Masua (Closing) (full)
Actually, this is the first time I have reached out to a musician to discuss these things. A friend of mine from Taiwan, who is a DP, told me that for graduation films, she usually discusses a percentage of the festival prize money with the musician. In exchange, the musician gives her a certificate of authorization. Since my film has no commercial purpose and is only for festival screenings, I’d love to know what you think of this approach, and what percentage you would suggest? Or do you have any other advice?

Thank you so much for your kind and detailed reply!
I have already filled out the enclosed form and sent you a separate appendix with the synopsis and description. It would be wonderful if you could check it out.
In addition, I would like to note that since this is an independent film and I don’t have a production company, I filled in “none” for some columns in the form.
As for the master recordings, since I only plan to submit this film to festivals and won’t be releasing it on DVD, I don’t need any special master copies. Just having the songs in WAV format would be perfect.
By the way, I have written descriptions of the scenes where I want to place the music. But if you could send me the WAV files, I could render a rough cut of the film with the music edited in for you to watch beforehand. I think that would be much more intuitive.
As for the deadline, the film needs to be shown at my school’s graduation screening on May 25th. So, we have plenty of time to make sure every detail is okay.

I will also arrange for wav of the recordings (that’s what I meant for masters of the recordings).
I note that in the last list of songs/recordings you wish to use “INNU” is not listed, is that correct? I mean you do not want to use it any longer?
Regarding “Term” of use I would suggest “in perpetuity” otherwise in one year time you shall need to ask again for the rights.

I’ve changed the ‘Term’ to ‘in perpetuity’ and am sending you the updated form enclosed.
Previously, I was considering using the opening part of the song INNU (about 5 seconds). However, after discussing the music with another director, we changed our edit so we don’t need that part anymore. Sorry for not mentioning this in my last email.

I also have just noticed that you indicated “China” only as territory for the rights. You won’t present this to other international film festivals outside of China? Just a question because in case you plan to present the movie to international movies outside of china you are not entitled to. So let me know if you wish to extend the rights to the world instead of China only.
